Transporting Firearms in Pennsylvania: Travel Rules

Pennsylvania Firearms Transport Beyond the Vehicle

Transporting firearms in Pennsylvania involves three layers: state law for in-state movement, federal FOPA for interstate travel, and TSA and common-carrier rules for air. This section covers transport beyond the everyday vehicle-carry rules in VEHICLE_CARRY. For the basic rule on carrying a handgun in your own car around Pennsylvania, start with VEHICLE_CARRY (18 Pa.C.S. 6106) and CONCEALED_CARRY. This section picks up where those leave off: long road trips through other states, flights with checked firearms, Amtrak and intercity bus, hunting and range trips, and the federal preemption rules that protect a Pennsylvania traveler.

Pennsylvania is a licensed-carry state, not a constitutional-carry state. A License to Carry Firearms (LTCF) under 18 Pa.C.S. 6109 is required to carry a firearm concealed on the person or in any vehicle. Open carry of a firearm without a license is lawful statewide for a person who may lawfully possess one, except in Philadelphia, where 18 Pa.C.S. 6108 requires a license to carry on public streets or public property.

How Pennsylvania transport law fits together

Three statutes do most of the work, plus one federal statute.

• 18 Pa.C.S. 6106 controls vehicle carry. Without a valid License to Carry Firearms, carrying a firearm in any vehicle anywhere in the Commonwealth is a felony of the third degree under 6106(a)(1), except as authorized by one of the 16 exceptions listed in 6106(b). The misdemeanor downgrade in 6106(a)(2) applies to a person otherwise eligible for an LTCF who has not committed any other criminal violation.
• 18 Pa.C.S. 6106(b)(8) lets an unlicensed Pennsylvania gun owner move a firearm at all: unloaded, in a secure wrapper, between enumerated points (place of purchase to home or business, to a place of repair, sale, or appraisal, a residence move, a home-to-vacation-home trip, a place of instruction, and certain court-ordered relinquishment locations).
• 18 Pa.C.S. 6106.1 prohibits carrying a loaded rifle or shotgun (a long gun, which is a weapon other than a "firearm" as defined in 18 Pa.C.S. 6102) in any vehicle, except as permitted by Title 34 for game. The penalty is a summary offense.
• 18 U.S.C. 926A (the Firearm Owners Protection Act) protects a non-prohibited person carrying a firearm interstate from a place where carry is lawful to another place where carry is lawful, provided the firearm is unloaded and stored as the statute requires. Section 6106(b)(14) cross-references 926A as a Pennsylvania-side defense.

The questions get interesting at three boundaries: state lines, security checkpoints, and the door of a common carrier.

Interstate transport under 18 U.S.C. 926A

The federal Firearm Owners Protection Act preempts state and local restrictions on a person moving a firearm between two places where possession and carry are lawful, provided the journey meets the statute's conditions. Pennsylvania expressly recognizes 926A through 18 Pa.C.S. 6106(b)(14), which references the interstate transportation of a firearm as defined under 18 U.S.C. 921(a)(3) in compliance with 18 U.S.C. 926A.

You qualify for 926A if all of the following are true:

• You are not otherwise prohibited from transporting, shipping, or receiving a firearm under federal law.
• You may lawfully possess and carry the firearm at both the start and end of the trip.
• During transport the firearm is unloaded.
• Neither the firearm nor any ammunition is readily or directly accessible from the passenger compartment.
• If the vehicle has no compartment separate from the driver's compartment (a hatchback, SUV, or pickup), the firearm and ammunition are stored in a locked container other than the glove compartment or console.

Practical notes:

1. Section 926A protects transport. It does not authorize stopping for a meal, hotel, or non-emergency errand in a state where possession of the firearm is unlawful. New York, New Jersey, Maryland, Massachusetts, and D.C. have prosecuted travelers who deviated from the safe-harbor configuration.
2. Section 926A authorizes transport "for any lawful purpose" and does not require a home destination, but possession must be lawful at both endpoints. A trip to a hunting lease in Maine through New York and Vermont qualifies. A trip to in-laws in New Jersey, where you have no permit and they do not allow firearms, does not, because possession at the New Jersey endpoint is unlawful.
3. Section 926A does not preempt state-law magazine capacity or assault-weapon restrictions during the journey. The safe answer is to comply with the most restrictive state's hardware rules along the entire route.

A non-resident driving through Pennsylvania between two other states does not need a Pennsylvania LTCF; 926A compliance is enough under 6106(b)(14). A Pennsylvania resident on a return leg without a current LTCF is also covered if the federal predicate is intact. Section 6122(b) requires producing satisfactory evidence of qualification for any 6106(b) exception on lawful demand. Keep a printout of the federal statute and your destination paperwork in the glove box.

Air travel: TSA and federal aviation security rules

Air travel with firearms is governed by federal aviation security law and TSA regulations, not by Pennsylvania's Crimes Code. The rules apply identically at every commercial airport in the Commonwealth. A valid LTCF holder is still barred from a TSA checkpoint while armed.

Two prohibitions to internalize:

1. You may not bring a firearm, loaded or unloaded, through a TSA passenger screening checkpoint. Doing so is a federal civil violation with penalties that can run into the thousands of dollars per offense, and it can also support a state criminal charge under local airport jurisdiction. Even a forgotten round in a backpack triggers the penalty. There is no LTCF exception.
2. You may not carry a firearm in the secure area of an airport, on a jet bridge, or aboard a passenger aircraft as a civilian. Under 49 U.S.C. 46505, having a concealed dangerous weapon accessible to you in flight, or placing a loaded firearm on the aircraft, is a federal felony punishable by a fine and up to 10 years in prison.

How to fly with a firearm lawfully

Firearms travel as checked baggage only, declared, unloaded, locked in a hard-sided container, in compliance with airline rules:

1. Confirm the firearm is unloaded. Inspect the chamber and any magazine traveling with it.
2. Place the firearm in a hard-sided container only you can unlock. Use a non-TSA lock; soft cases are not acceptable. The traveler retains the only key or combination.
3. Place the locked case inside checked baggage. Airline rules vary on whether the hard case can be checked alone or must be inside a larger bag.
4. Pack ammunition in the manufacturer's original packaging or in a fiber, wood, plastic, or metal box designed for ammunition. Loose rounds are not permitted.
5. At the airline counter, declare the firearm. The agent will give you a declaration tag to sign and place inside the case.
6. Wait at the counter or accompany the bag to TSA inspection if instructed. Lock the case yourself before it goes onto the belt.
7. At your destination, claim the bag at the regular carousel. If it is missing, report it immediately to airline baggage service.

The Pennsylvania LTCF authorizes carry in the public, unsecured terminal areas (curb, ticketing lobby, baggage claim) up to the security checkpoint. It does not authorize anything on the secure side and provides no defense to a TSA prohibited-items violation. Common mistakes: a handgun in carry-on at the X-ray belt; a forgotten round in a coat pocket; treating an antique firearm as exempt (it is not, for TSA purposes).

Amtrak, intercity bus, and other common carriers

Amtrak permits unloaded firearms in checked baggage on most trains with checked baggage service. The traveler must give Amtrak at least 24 hours' notice, declare at check-in, and pack the firearm unloaded in a locked, hard-sided container. Ammunition, up to a stated weight limit, may travel in the same container or a separate locked one. Trains without checked baggage service (most Northeast Corridor regional and Keystone service trains between Harrisburg and New York) do not permit firearms aboard. Confirm before booking.

Intercity bus. Most carriers prohibit firearms in carry-on and impose strict checked-baggage rules. Greyhound permits unloaded firearms in checked baggage with declaration; Megabus does not accept firearms in any baggage. Treat each carrier as a separate contract.

SEPTA and other transit. Pennsylvania's mass-transit systems are public carriers. An LTCF authorizes carry on most public transit in the Commonwealth, subject to two qualifications: 6108 still applies on transit property within Philadelphia city limits, and individual transit systems may post against firearms by published policy.

Charter and rental vehicles. A rented car is a vehicle for 6106 purposes. The rental agreement does not change Pennsylvania law. An LTCF holder may carry in a rental the same as in a personal car. Some rental companies prohibit firearms by contract; that is a contract issue, not a criminal one.

Hunting, trapping, fishing, and range transport

Section 6106(b)(9) exempts from the LTCF requirement any person licensed to hunt, take furbearers, or fish in the Commonwealth, while actually engaged in that activity or going to or returning from the places where they desire to do it. A licensed deer hunter driving to a tree stand in Tioga County with a hunting rifle and an appropriate sidearm is in 6106(b)(9) territory for the trip.

Sportsman's Firearm Permit

Under 6106(c), before the 6106(b)(9) exception applies, a person 18 years of age or older licensed to hunt, trap, or fish must secure a Sportsman's Firearm Permit from the county treasurer. The permit:

• Costs no more than $6 and is issued immediately by the county treasurer.
• Is valid throughout the Commonwealth for 5 years from the date of issue.
• Authorizes carry only when carried in conjunction with a valid hunting, furtaking, or fishing license.
• Is not a concealed-carry license. It does not authorize general vehicle carry or concealed carry off the hunt.

An LTCF holder does not need a Sportsman's Firearm Permit; the LTCF covers everything the sportsman's permit covers and more.

Loaded long guns in the vehicle

Section 6106.1 prohibits carrying a loaded rifle or shotgun in any vehicle, except as permitted by Title 34 for game. Driving to a deer stand with a loaded rifle on the back seat is a 6106.1 summary offense even for an LTCF holder, because 6106.1 reaches long guns regardless of license status. The statute does carve out persons exempt under 6106(b)(1), (2), (5), and (6), such as law enforcement officers, but not ordinary LTCF holders. Unload before you put the long gun in the vehicle. Reload only after you reach the hunting area on foot.

Range trips and place of instruction

Range and instruction transport fits inside the 6106(b)(8) secure-wrapper rule. Section 6106(e)(2) defines "place of instruction" to include any "hunting club, rifle club, rifle range, pistol range, shooting range, the premises of a licensed firearms dealer or a lawful gun show or meet." Target-shooting transport can also fall under 6106(b)(4), which covers a person going to or from a place of assembly or target practice with an unloaded firearm. A non-LTCF student driving to a CCW class, public range, or rifle club may transport an unloaded firearm in a secure wrapper:

1. Confirm the destination is a 6106(b)(8) category (or that the trip is target practice under 6106(b)(4)).
2. Unload the firearm completely. Remove the magazine. Clear the chamber.
3. Place the firearm in a closed, hard-sided gun case. A snapped holster is not a secure wrapper.
4. Place the case in the trunk. If the vehicle has no trunk, place it where it is not readily accessible to the occupants.
5. Pack ammunition separately.
6. Drive directly to the range. Side trips for unrelated errands take you outside (b)(8).

For an LTCF holder, none of this is required.

A Pennsylvania resident driving a hunting rifle and sidearm to a lease in another state is on an interstate trip: apply the 926A analysis. If carry is lawful at both endpoints, 926A protects the journey through any intervening state.

Out-of-state license holders driving in or through Pennsylvania

Pennsylvania recognizes out-of-state carry permits three ways for transport purposes.

• Section 6109(k) reciprocity agreements. The Attorney General enters reciprocity agreements with other states for mutual recognition of carry licenses, which authorize both vehicle carry and concealed carry on the person, the same as a Pennsylvania LTCF. The Attorney General maintains and publishes the current list. New Jersey, New York, Delaware, Maryland, and D.C. are not reciprocity partners.
• Section 6106(b)(11) vehicle exception. Any person carrying a firearm in a vehicle who possesses a valid and lawfully issued license for that firearm under the laws of the United States or any other state is exempt from 6106's vehicle prohibition. This exception is broader than (k) because it does not require a reciprocity agreement, but narrower in that it authorizes vehicle carry only, not concealed carry off the vehicle.
• Section 6106(b)(15) unilateral recognition. Even without a (k) agreement, Pennsylvania recognizes an out-of-state license if the issuing state provides a reciprocal privilege for Pennsylvania licensees and the Attorney General has determined that the state's firearm laws are similar to Pennsylvania's.

A Texas LTC holder driving from Texas to Connecticut through Pennsylvania has two sources of Pennsylvania-side transit authority: 6106(b)(11) and 6106(b)(14). Once into New York, 926A becomes the only safe configuration.

A Pennsylvania LTCF holder driving to a game at Citi Field has a different problem. The LTCF is not recognized in New York. The only lawful posture for the New York portion is 926A: unloaded, locked away from the passenger compartment, true transit between two carry-lawful endpoints. An overnight stay in New York takes the trip outside the safe harbor. Many instructors advise leaving the firearm at home for trips of this type.

Transport during declared emergencies

Section 6107 provides that no person shall carry a firearm upon the public streets or upon any public property during an emergency proclaimed by a state or municipal governmental executive unless that person is actively engaged in defense of life or property, is licensed to carry under 6109, or is exempt from licensing under 6106(b). The rule applies during hurricanes, blizzards, civil disturbances, and similar declared events.

For transport purposes:

• An LTCF holder driving during a declared emergency is covered under 6107(a)(2).
• A 6106(b)(8) secure-wrapper transit (range, repair, residence move) is also covered, because the 6106(b) exceptions qualify under 6107(a)(2).
• An open carrier on foot on a non-Philadelphia public street during an emergency, without an LTCF and without a 6106(b) exception, falls within the 6107 prohibition. The statute does not assign a specific offense grade.
• Section 6107(b) prohibits seizure or confiscation of firearms, accessories, or ammunition during an emergency unless the seizure would be authorized absent the emergency.

Possession by minors during transport

Section 6110.1 generally prohibits a person under 18 from possessing or transporting a firearm anywhere in the Commonwealth, with two exceptions: (1) the minor is under the supervision of a parent, grandparent, legal guardian, or an authorized adult and is engaged in lawful activity such as safety training, lawful target shooting, or organized competition, or is transporting an unloaded firearm for a lawful purpose; and (2) lawful hunting or trapping under Title 34. A non-LTCF parent driving the minor and an unloaded firearm to a competition is on 6106(b)(8) secure-wrapper transport, with the minor's possession authorized through 6110.1(b)(1). An adult who knowingly and intentionally provides a firearm to a minor outside these exceptions commits a felony of the third degree under 6110.1(c).

Pennsylvania-specific traps for travelers

• Loaded long gun in a vehicle is always a violation. Section 6106.1 has no LTCF exception for ordinary license holders. An LTCF holder transporting a loaded shotgun for a hunting trip commits a summary offense unless the conduct is authorized under Title 34 during legal hunting.
• Antique firearms still count for 6106. Under 6118(b), the antique-firearm exemption in 6118(a) does not apply when the antique is carried concealed or in a vehicle in a way that requires a license under 6106. An antique carried concealed or in a vehicle still requires an LTCF.
• Federal indictment changes the rule under 18 U.S.C. 922(n). A person under indictment for a crime punishable by imprisonment for more than one year may not ship, transport, or receive a firearm in interstate or foreign commerce, regardless of state license status. (Being under indictment is addressed by 922(n), not by 922(g).)
• Federal facility carry is off-limits everywhere. Under 18 U.S.C. 930, knowingly possessing a firearm in a federal facility (a building or part of one owned or leased by the federal government where federal employees are regularly present) is a federal offense. Post office property, including parking lots, is also restricted under USPS regulation 39 CFR 232.1.

Penalties at a glance

The two lines that catch most non-prohibited travelers are 6106.1 (loaded long gun in a vehicle) and accidental TSA violations. Both are avoidable with a one-minute check before each trip: was the rifle or shotgun unloaded before it went into the vehicle, and was every bag swept for ammunition before leaving for the airport.

Key statutes reference

Ambiguities and notes

• "Secure wrapper" in 6106(b)(8) is not statutorily defined. Sheriff's office guidance and instructor practice treat the term as requiring a closed, hard-sided case or factory box. A snapped holster, soft sleeve, or paper bag is not a secure wrapper.
• "Readily accessible" in 18 U.S.C. 926A is a fact question. The conservative posture is to treat the firearm as inaccessible only when locked away from the passenger compartment, in the trunk where the vehicle has one or in a locked container otherwise.
• For out-of-state drivers, 6106(b)(11) is the cite for vehicle transit, while 6106(b)(15) is the cite for full vehicle-and-on-person recognition where the Attorney General has made the parity determination.
• Section 6108 was declared unconstitutional as applied on June 23, 2025, by the Superior Court of Pennsylvania in Commonwealth v. Sumpter, 340 A.3d 977 (Pa. Super. 2025). Treat 6108 as still in force for transport purposes inside Philadelphia until the Supreme Court or the legislature acts.
• TSA penalty schedules and airline policies change over time. Confirm before each trip. Amtrak and intercity bus policies vary by carrier and route.
