Transporting Firearms in Nevada: Travel Rules

Transporting Firearms in Nevada and Across State Lines

The Headline

Nevada places few restrictions on transport of firearms within the state. A non-prohibited adult may transport a firearm, loaded or unloaded, openly or concealed (when concealed, only with a CFP), in their own private vehicle. Interstate transport is governed by the federal Firearms Owners Protection Act (FOPA), 18 U.S.C. Section 926A, which provides an affirmative defense for transport of an unloaded firearm in a locked container, ammunition stored separately, when traveling between two states where the possession is lawful.

For air travel, 49 U.S.C. Section 46505 and TSA regulations at 49 C.F.R. Section 1540.111 govern: firearms must be declared, unloaded, in a hard-sided locked case, with ammunition packed separately, in checked baggage only.

Intrastate transport in Nevada

A person who lawfully possesses a firearm in Nevada may transport it within the state by:

• Private motor vehicle: any compartment; loaded or unloaded; no locked-container requirement. See VEHICLE_CARRY.
• Foot or bicycle: open carry without permit; concealed carry requires CFP.
• Public transit: Las Vegas Monorail and RTC buses post against firearm carry; firearm transport on transit is private-property restricted (refusal-to-leave is trespass under NRS 207.200). RTC also has its own armed-security policy.
• Taxis and ride-share: operator's policy governs (most operators prohibit firearms in their terms of service).
• Rental vehicles: same rules as a personally owned vehicle. The rental company's policy may add restrictions; check the rental agreement.

There is no statewide locked-container requirement for transport of a handgun or long gun in a private vehicle in Nevada, unlike states such as Massachusetts or New York. A non-prohibited person may transport with the firearm loose on the seat, in the trunk, in the glove compartment, or anywhere else convenient.

Long gun in motor vehicle during hunting: NRS 503.165 prohibits a loaded rifle or shotgun in or on a motor vehicle that is in motion on a public road or highway when the person is hunting. This is a hunting-specific rule under Title 50 (Wildlife), not a general carry restriction, and does not apply to handguns. See VEHICLE_CARRY.

Interstate transport into and out of Nevada

A person traveling through Nevada by vehicle from one state to another generally has the protection of 18 U.S.C. Section 926A (FOPA). FOPA provides:

"Notwithstanding any State or any political subdivision thereof, any person who is not otherwise prohibited by this chapter from transporting, shipping, or receiving a firearm shall be entitled to transport a firearm for any lawful purpose from any place where he may lawfully possess and carry such firearm to any other place where he may lawfully possess and carry such firearm if, during such transportation the firearm is unloaded, and neither the firearm nor any ammunition being transported is readily accessible or is directly accessible from the passenger compartment of such transporting vehicle: Provided, That in the case of a vehicle without a separate compartment from the driver's compartment, the firearm or ammunition shall be contained in a locked container other than the glove compartment or console."

Key elements of FOPA protection:

1. The traveler must be a non-prohibited person. A felon, fugitive, etc., loses FOPA protection.
2. Possession must be lawful at both the origin and destination states. A person traveling from Texas (lawful) to California with a magazine over California's lawful capacity is not protected for the over-capacity magazine.
3. The firearm must be unloaded during transport.
4. Neither the firearm nor ammunition may be "readily accessible" from the passenger compartment. In a sedan or van, this means the firearm and ammunition must be in the trunk or other compartment separate from the driver/passenger area. In a vehicle without a separate trunk (e.g., a pickup truck without a covered bed, or an SUV), the firearm and ammunition must be in a locked container other than the glove compartment or console.
5. The transit must be for a lawful purpose. Stopping for fuel, food, rest, or routine repairs is generally consistent with "transit"; an extended stay (e.g., overnight stay in a hotel) may take the traveler outside the FOPA framework, particularly if local law would have prohibited the firearm at the stop location.

FOPA is an affirmative defense at trial, not pretrial immunity. A traveler stopped by state police may still be cited or arrested; the FOPA defense is raised at trial. Some courts (notably in New York and New Jersey) have applied FOPA narrowly; the Ninth Circuit (Nevada is in the Ninth Circuit) has applied FOPA more broadly.

Air travel - declaring firearms in checked baggage

Federal law and TSA regulations govern firearm transport by air. Per 49 C.F.R. Section 1540.111:

• Firearm must be unloaded.
• Firearm must be in a hard-sided locked container. Soft-sided cases are not compliant.
• Container must be locked with a key or combination known only to the passenger. TSA may need to inspect; if so, the passenger must be present to open the container at TSA request.
• Ammunition must be in a separate hard-sided container, in approved packaging (factory-original cardboard box, plastic ammunition box, fiber boxes specifically designed for ammunition). Magazines must also be stored in approved packaging; many travelers store magazines in the same hard case as the firearm.
• The firearm and ammunition must be declared to the airline at the check-in counter. The passenger signs an unloaded-firearm declaration; the airline tag is placed inside the case or on the case itself.
• Firearms cannot be transported in carry-on baggage. A loaded firearm or a firearm in a carry-on bag is a federal offense under 49 U.S.C. Section 46505, punishable by up to 10 years.

Some airlines have additional restrictions (e.g., a per-flight handgun limit, restrictions on certain calibers, magazine capacity limits on specific routes). Confirm with the airline 72 hours before departure.

Reaching the airport with a firearm: a CFP holder may carry concealed in the public (pre-screening) area of the airport. Before entering the security checkpoint, the firearm must be declared and transferred to checked baggage. Carrying past the TSA checkpoint with a firearm in carry-on is a federal felony under 49 U.S.C. Section 46505; the carrier will be cited, the firearm seized, and any CFP may be revoked.

Train travel - Amtrak

Amtrak permits transport of firearms in checked baggage on routes where checked-baggage service is available, with declaration similar to air-travel rules. Firearms must be unloaded, in a hard-sided locked container, with ammunition packed separately. Amtrak charges a small handling fee.

Some Amtrak routes (e.g., commuter rail and short-distance routes) do not offer checked baggage; on those routes, firearm transport is prohibited. The Coast Starlight, California Zephyr, and Sunset Limited (which serve Nevada via the Reno station) do offer checked baggage and accept declared firearms.

Postal shipment of firearms

The U.S. Postal Service has restrictive rules on firearm shipment under federal law:

• Long guns (rifles, shotguns) may be shipped USPS via registered mail or first-class mail with appropriate packaging and labeling. The sender must be a non-prohibited person; the recipient must be a federally licensed firearm dealer (FFL) unless other limited exceptions apply.
• Handguns generally cannot be shipped USPS by a non-licensed individual; handguns must be shipped via UPS or FedEx through an FFL, or by an FFL directly. The 18 U.S.C. Section 922(a) framework applies.

A private individual shipping a firearm should ship through an FFL on both ends of the transaction to remain compliant with federal interstate transfer rules.

Shipping ammunition

Ammunition may be shipped by USPS Parcel Post (not Priority or First-Class), UPS, or FedEx. Restrictions:

• Cannot be shipped by air (USPS) - ground only;
• Maximum weight limits per package;
• Hazmat declaration may be required;
• Recipient must be a person of legal age (18 for rifle/shotgun ammunition, 21 for handgun ammunition under federal law).

Common transport violations to avoid

• Forgetting a magazine or stray cartridge in carry-on baggage. TSA detects this with regularity at McCarran/Reid International (Las Vegas) and Reno-Tahoe International. The traveler is cited; the cartridge or magazine is seized.
• Transporting through a posted-restricted location (school grounds, federal facility, posted government building). NRS 202.3673 and federal 18 U.S.C. Section 930 apply.
• Stopping overnight in California with a Nevada-lawful firearm or magazine that exceeds California limits. California law applies during the stay.
• Stopping in a casino parking lot with firearms in the vehicle in plain view. The casino as private property may exclude even by signage on the parking lot; refusal to leave the lot when asked is trespass.
• Crossing into Mexico (Las Vegas area, ~250 miles to the Mexican border) with a firearm or ammunition. Mexico's gun laws are extremely restrictive; even a single cartridge can result in a multi-year sentence in Mexican prison.

Federal LEOSA transport

A qualified active or qualified retired LEO carrying under 18 U.S.C. Section 926C may transport a firearm interstate under the LEOSA framework. LEOSA preempts state and local transport restrictions for the qualified officer but does not override federal facility restrictions (18 U.S.C. Section 930) or aircraft restrictions (49 U.S.C. Section 46505).
